1 Definitions
1.1 The term “on-line contract of sale” means the purchase agreement relating to movable tangible goods sold by ORUM OCCHIALI, concluded between the same and the Customer as part of a remote sales system via telematics, organized by ORUM OCCHIALI.
1.2 The term “Customer” means the individual consumer that makes the purchase of this contract, for purposes not related to their business or profession.

2 Subject of the Contract
2.1 With this contract, respectively, ORUM OCCHIALI sells and the Customer buys movable goods from a distance through telematics, that were displayed and offered for sale on the site

3 Stipulations and Conclusion of the Contract

4 Payment Methods
4.1 Each payment made by the Customer can only take place through one of the methods listed on the site Credit cards of the major international circuits, prepaid and rechargeable cards issued by banks in the Italian area are accepted: VISA, MASTERCARD, AMERICAN EXPRESS, POST PAY.
4.2 For payments made by credit card, the actual charge of the order will only take place when it is complete and ready to ship. 4.3 In order to protect the Customer, all orders are subject to control before being processed directly by the institutions issuing the credit cards. 5 Prices
5.1 Prices displayed on the site include VAT and refer only to the products sold online. The price charged will be the one in force at the time of the order and in the email confirmation of the order, regardless of increases or decreases in prices, even for promotions, which may have occurred in the meantime.
5.2 The shipping costs are included in the purchase price and are indicated and calculated at the conclusion of the buying process before payment.
5.3 An official invoice will not be issued unless it is specifically requested by the Customer no later than the moment of the transaction, as indicated in Art. 22 of Presidential Decree of 26/10/1972 n. 633. By sending the order to ORUM OCCHIALI the Customer agrees to receive the invoice / receipt in electronic format. The Customer can receive the invoice / receipt in hard copy upon written request to ORUM OCCHIALI. After the issuance of the invoice, no further changes can be made to the said data.

6 Product Availability
6.1 Product availability refers to the time when the Customer see the product info-sheets; This must still be deemed to be merely indicative because, owing to the presence of multiple users on the site simultaneously, the products could be sold to others before confirming the order. In any case no liability can be attributed to ORUM OCCHIALI in the case of unavailability of one or more products.
6.2 ORUM OCCHIALI will not be in any way responsible for the temporary or permanent unavailability of one or more products. 7 Delivery Methods
7.1 ORUM OCCHIALI will deliver the selected and purchased products by courier to the address specified by the Customer when ordering, as confirmed in the e-mail summary of point 3.3.
7.2 Orders will be processed on receipt. ORUM OCCHIALI strives to deliver its products as quickly as possible and within three days from the date the order was received from the Customer, with the exception of the month of August.
7.3 The total amount of expenditure will be visible before proceeding with the purchase confirmation.
7.4 The delivered goods will be checked and delivered to the shipping company intact and without defects. ORUM OCCHIALI will not be held in any way responsible for any delay or damage attributable to the fault of the shipper.

8 Responsibility
8.1 ORUM OCCHIALI does not assume responsibility for being unable to execute the order within the time stipulated in the contract in the case of disruptions in service caused by force majeure or unforeseeable circumstances, even those resulting from failures and outages of the Internet.
8.2 ORUM OCCHIALI will not be liable for any damages, losses and costs incurred by the Customer as a result of breach of contract for reasons not attributable to the same, and only if they depended on acts or omissions of ORUM OCCHIALI, the customer is entitled to a reimbursal of the price paid and any charges incurred.

9 Return Policy
9.1 The Customer has the right to cancel the contract without penalty, specifying the reason, within 14 working days from the day of receipt of the products, by sending a written notice by registered letter a / r to ORUM OCCHIALI, Via San Gallo 130 / R, Florence, Italy. 10 Guarantees and Forms of Assistance
10.1 ORUM OCCHIALI markets eyewear of high quality. In case of receipt of any product not complying with the contract of sale, in accordance with articles 129 et seq. of the Consumer Code, the Customer loses all rights unless the defect is communicated to the seller within a period of two months from the date the defect was discovered. The complaint is not required if the seller has acknowledged the existence of the defect or has concealed it.

10.4 The request should be sent in writing, by registered mail, to ORUM OCCHIALI, Via San Gallo 130 / R, Florence, Italy, which will indicate their disponibility to act on the request, or the reasons they are unable to do so, within seven working days of receipt. In the same communication, when the Customer’s request has been accepted, ORUM OCCHIALI will indicate the method of delivery or return of the goods, as well as the deadline for the return or replacement of defective goods.
10.5 If repair and replacement are impossible or excessively expensive, or ORUM OCCHIALI has failed to repair or replace the goods within the period referred to in the preceding paragraph or, finally, the replacement or repair carried out previously has caused significant inconvenience to the Customer, an appropriate price reduction or termination of contract may be requested. The Customer will then have to send their request to ORUM OCCHIALI, which will indicate their disponibility to act on the request, or the reasons they are unable to do so, within seven working days of receipt.
10.6 In the same communication, when the customer’s request has been accepted, ORUM OCCHIALI will indicate the price reduction proposal or how to return the defective goods. In these cases it is the responsibility of the Customer to indicate how to refund the amount previously paid to ORUM OCCHIALI.

11 Customer Obligations
11.1 The Customer agrees to pay the price of the goods purchased in the time and manner specified by these Conditions of Sale.
11.2 Once the purchase process online has been concluded, The Customer agrees to print and conserve these Conditions of Sale, which were expressly accepted before the conclusion of the procedure.
